Jury finds for Shale Exploration, LLC and awards compensatory and punitive damages against Eagle Oil and Gas on misappropriation of trade secrets claim.
Houston, Texas (September 16, 2014) – A Harris County jury returned a $19 million verdict for Shale Exploration LLC, a Ft. Worth-based oil and gas exploration company, finding that Dallas-based Eagle Oil & Gas had stolen part of a proprietary oil and gas prospect developed by Shale in Montana called the Jayhawk. Cause No. 2012-25694; Shale Exploration, LLC v. Eagle Oil & Gas Co. and Eagle Wes-Tex, LP; In the 152nd Judicial District Court, Harris County, Texas.

After a two and half week trial, the jury found Eagle Oil and Gas breached a confidentiality and non-circumvention agreement with Shale, and that Eagle unlawfully took trade secrets and proprietary information about Shale’s prospect for its own use. The jury awarded Shale $14.3 million in compensatory damages and $4.5 million in punitive damages for Eagle’s malicious conduct.
